1.Agreement
These terms of service (the "Terms") form a binding contract between Fitness Industry Sales LTD ("we", "us") and you when you create or use a pitch.lab account, install or use the pitch.lab MCP connector inside ChatGPT, Claude or any compatible client, or otherwise access the pitch.lab application or APIs. By creating an account or connecting the MCP server you confirm that you have read, understood and agree to be bound by these Terms and by the privacy policy.
2.The service
pitch.lab provides predictions, analytics and advisory tooling for Fantasy Premier League (FPL) managers and for the FIFA World Cup 2026 tournament, exposed through (a) a hosted web application, (b) a JSON HTTP API, and (c) a Model Context Protocol (MCP) server connectable to large-language-model clients including ChatGPT and Claude. The MCP server is read-only — it does not place wagers, execute FPL transfers, or modify any third-party account on your behalf.
3.Eligibility, registration and account
You must be at least 18 years old to register a pitch.lab account. If you are creating an account on behalf of a business or other organisation, you confirm that you have authority to bind that entity to these Terms. You are responsible for the security of your login credentials, your API keys (the raw key value is shown only once at generation), and any OAuth clients you authorise against your account. Notify us promptly if you suspect unauthorised use of your account.
4.Fees and payment
pitch.lab is currently provided free of charge. We may introduce paid plans in the future; if we do, we will give you at least 30 days' notice by email before any charge is applied to your account, and you will have the opportunity to cancel without charge. Free use is provided without commitment to feature parity, usage volume guarantees, or any service-level agreement.
5.Your data and our use of it
You own your pitch.lab account data and your FPL team data. You grant us a worldwide, royalty-free, non-exclusive licence to host, process, transmit, copy, display and otherwise use your account data solely as necessary to operate and improve the service. Aggregated and de-identified data derived from your usage (where it cannot reasonably be linked back to you) may be used for service analytics, model training, and product improvement. 6.Acceptable use
You agree NOT to:
- Use the service for any unlawful purpose, including market manipulation, fraud, money laundering, or to evade sanctions.
- Attempt to gain unauthorised access to any part of the service, any other user's account, or any system or network connected to the service.
- Reverse-engineer, decompile or disassemble the service, except to the extent expressly permitted by mandatory applicable law.
- Scrape, mirror, or systematically extract data from the service beyond what your normal usage of the documented MCP tools and API endpoints requires.
- Resell, redistribute or commercially exploit the service or its output without our prior written permission, except where you are a registered user using the MCP connector inside ChatGPT or Claude for your own analytical purposes.
- Use the service to harass, defame, impersonate or harm any other person.
- Submit deliberately malformed requests, brute-force credentials, or send a volume of requests intended to degrade availability.
We may suspend or terminate access for breach of any of the above, with or without notice depending on severity.
7.Third-party platforms
pitch.lab connects to and reads from third-party platforms, including the Fantasy Premier League public API, football-data.org, Understat, OpenWeatherMap, API-Football and The Odds API. We are not affiliated with, endorsed by, or responsible for any of these platforms. Your use of any third-party platform is governed by that platform's terms and privacy policy. Likewise, when you access pitch.lab through ChatGPT or Claude, your use of those services is governed by OpenAI's and Anthropic's respective terms.
8.AI-generated content and accuracy
Predictions, suggested transfers, Pitch.lab Difficulty Ratings, captain comparisons, and any other analytical output produced by pitch.lab are model-driven estimates. They may be inaccurate, incomplete, out of date, or otherwise unsuitable for your purpose. FPL outcomes are stochastic, no model can predict them perfectly, and historical performance is not a guarantee of future results. You are solely responsible for any decision you make in your own FPL team or otherwise on the basis of this output. The service is provided for informational and entertainment purposes; it is not financial, betting, gambling or investment advice, and is not a substitute for your own judgement.
9.Confidentiality
Each party agrees to protect the other's confidential information with at least the same degree of care it uses for its own confidential information of similar importance, and never less than reasonable care. "Confidential information" means non-public information disclosed by one party that the other party knew or should reasonably have known was confidential. This obligation does not apply to information that is or becomes public through no fault of the recipient, was already known to the recipient, or is disclosed by a third party with the right to do so.
10.Intellectual property
All right, title and interest in and to the service — including the website, codebase, models, the Pitch.lab Difficulty Rating algorithm, documentation, design and branding — are and remain owned by us and our licensors. These Terms do not grant you any ownership of, or licence to, our intellectual property other than the limited right to use the service in accordance with the Terms. You retain ownership of your account data and FPL team data.
11.Service availability and changes
We aim for high availability but do not guarantee uninterrupted or error-free operation. We may perform planned maintenance, unplanned maintenance during incidents, and rolling deploys; the MCP server may be briefly unavailable during these. We may add, change, deprecate or remove features at any time. For material changes that meaningfully reduce functionality you rely on, we will give reasonable notice (typically 30 days) by email or in-product banner.
12.Suspension and termination
You may close your pitch.lab account at any time by emailing [email protected]. We may suspend or terminate your access if (a) you breach these Terms, (b) we reasonably believe your usage threatens the security, availability or integrity of the service, or (c) we are required to do so by law. On termination we will delete or anonymise your account data within 30 days, except where law requires longer retention.
13.Warranties and disclaimers
Subject to clause 14 (Limitation of liability) below, the service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy of output, non-infringement, and quiet enjoyment. We do not warrant that the service will meet your requirements, that any predicted outcome will materialise, or that the service will be free from errors, defects or interruptions.
14.Limitation of liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under English law. Subject to that, our total aggregate liability arising out of or related to the service, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the greater of (a) the fees you paid to us in the 12 months preceding the event giving rise to liability and (b) £100. We are not liable for any indirect, special, incidental, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business opportunity, goodwill, data, or any FPL or betting outcome, however caused.
15.Indemnity
You agree to indemnify, defend and hold harmless Fitness Industry Sales LTD, its directors, officers, employees and contractors from and against any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your violation of any applicable law in connection with your use of the service, or (c) any content or prompt you submit that infringes a third party's rights.
16.Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by the laws of England and Wales. You and we agree to the exclusive jurisdiction of the courts of England and Wales, except that we may bring proceedings to enforce our intellectual-property rights in any jurisdiction where infringement occurs.
17.Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. For material changes we will give you at least 14 days' notice (30 days for changes to pricing once paid plans exist) by email or in-product banner. Continued use of the service after the notice period constitutes acceptance of the updated Terms. If you do not accept the changes, you may close your account before they take effect.
18.Miscellaneous
- Entire agreement — these Terms plus the privacy policy form the entire agreement between us and supersede any prior agreements on the same subject matter.
- Severability — if any provision is held unenforceable, the rest remain in force.
- Assignment — you may not assign your rights under these Terms without our written consent. We may assign ours in connection with a merger, acquisition, sale of assets or by operation of law.
- Force majeure — neither party is liable for any failure or delay caused by events outside its reasonable control.
- Notices — to us: emailing [email protected]; to you: the email address on your account.
- No waiver — our failure to enforce a right does not waive it.
- No third-party beneficiaries — these Terms do not give rights to anyone other than the parties.
